Technology Development Needs Anticipatory Policies

The commitment of regulators in the telecommunications sector to act as facilitators was finally proven by the issuance of an anticipatory policy, namely the Regulation of the Minister of Communication and Information Technology No.1 / 2021, as an amendment to Ministerial Regulation No.13 / 2019 concerning the Operation of Telecommunications Services.

This regulation spirit integrates rules related to services into one Ministerial Regulation, adjusting the provisions of administrative sanctions, simplifying development commitments, and clarifying previous requirements that were still gray.

Simply put, this rule comes out by considering technological developments and new business models in the telecommunications world as an anticipatory step that needs to build ecosystems and increase economic growth.

There are several changes in this new rule so that it can be considered anticipatory with technological developments.

First, the regulator breaks the definition of content services into four categories:

  • Premium short message content services (Premium SMS)
  • Premium call services
  • Other value-added telephony services
  • Other multimedia services

The first two services are already running at this time, but as technology develops, there is the potential for new forms of assistance to existing so that regulators anticipate it by including two other services in this regulation.

Other value-added telephony services are included in the operation of value-added telephony services, and multimedia services are included in the operation of multimedia services.

Second, there is an opportunity to add to telecommunications service providers, divided into three categories: the operation of essential telephony services and value-added telephony services, and multimedia services.

Third, telephony Internet service providers for public purposes (ITKP) now allow channeling incoming calls from outside Indonesia’s territory.

ITKP providers can channel incoming calls (incoming calls) based on the internet protocol from outside the territory of Indonesia by guaranteeing and reporting that global partners are legitimate senders, and we can trace the source of phone calls.

In addition to anticipatory strategic policies, this regulation also accommodates the needs for communication channels from ministries, agencies, or parties determined by the Minister to the public via SMS blasts.

SMS blasts for important information related to state security, natural disasters, disease outbreaks, and other dangers that threaten the safety of human life and property will send without charge.

Of course, there is potential for new state revenue where the revenue of call center service providers (Call Center) from managing public services using access codes assigned to Government Agencies and State-Owned Enterprises (SOEs) is subject to Telecommunication Operation Right Fee (BHP) and contributions. Universal Service Obligations (KPU / USO) take effect from the fiscal year 2022.

Another significant change is the granting of greater authority to the Director-General (Dirjen) / echelon one level, where the Minister carries out supervision and control over the implementation of this regulation through the Director-General. In the previous regulation, this handle by the Minister.

The Director-General can even determine the operation of other telecommunications services based on developments in information and communication technology (ICT) and the health of the telecommunications industry.

The Director-General also stipulates provisions regarding types and criteria to build ecosystems and increase Indonesia’s economic growth.
